NOTICE FOR CALIFORNIA RESIDENTS ABOUT CONSUMER PRIVACY:

PRB is providing this Supplemental Privacy Policy to give California residents the additional information required by the California Consumer Privacy Act (the “CCPA”) and the California Privacy Rights Act (the “CPRA”).

At PRB, we are committed to protecting the privacy and security of all the Personal Information (the “PI,” “Personal Data”) that is entrusted to us.  Please refer to our Privacy Policy, for additional details regarding our privacy and security practice.

1. WHO IS RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA?

The PRB entity responsible for the processing of your personal data will depend on how you interact with our platform. The relevant PRB entity is referred to as “PRB”, “our”, “we” or “us” in this Supplemental Privacy Policy.

2. PRB DOES NOT SELL OR SHARE YOUR PERSONAL INFORMATION

The CCPA and CPRA requires us to disclose whether we sell or share your Personal Information. We do not sell or share your Personal Information.

3. YOUR RIGHTS UNDER THE CCPA AND CPRA

The CCPA and CPRA provides Californians with the following rights:

3.1 Requests for Information

You (or your authorized agent) can request a copy of your Personal Information. Under the CCPA and CPRA, you can also request that we disclose how we have collected, used, and shared your Personal Information over the past 12 months, including the categories of PI we collected and our purposes for doing so; the categories of sources for that information; the categories of third parties with whom we shared it for a business purpose and our purposes for doing so.

3.2 Your Right to Opt Out of Sales or Sharing of Personal Information

We do not sell or share Personal Information, so we don’t have an option to opt out.

3.3 Your Right to Notification

Under the CCPA and CPRA, a company cannot collect new categories of Personal Information or use PI for materially different purposes without first notifying you.

3.4 Nondiscrimination for exercising your CCPA and CPRA Rights

The CCPA and CPRA prohibit businesses from discriminating against you for exercising your rights under the law. Such discrimination may include denying services, charging different prices or rates for services, providing a different level or quality of services, or suggesting that you will receive a different level or quality of goods or services as a result of exercising your rights.

3.5 Your Right to Delete Personal Information

You can request that we delete your Personal Information. We honor such requests, unless an exception applies, such as when the information is necessary to complete the transaction or contract for which it was collected or when it is being used to detect, prevent, or investigate security incidents, comply with laws, identify and repair bugs or ensure another consumer’s ability to exercise their free speech rights or other rights provided by law.

3.6 Right to Correct Personal Information

You have a right to rectify inaccurate Personal Data and, taking into account the purpose of processing the Personal Data, ensure it is complete.

3.7 Right to Transfer Your Data

You have the right to request that businesses transfer Personal Information to another entity, to the extent it is technically feasible.

3.8 Right to Limit Use and Disclosure of Sensitive Personal Information

You have the right, at any time, to direct a business that collects sensitive Personal Information about the consumer to limit its use of the consumer’s sensitive Personal Information. We do not collect sensitive Personal Information.

3.9 Right to Access Information About Automatic Decision Making 

You have the right to access information about how companies use automated decision-making technology. The CPRA allows consumers the right to opt-out of any automated decision-making processes.

Primary Commercial Purposes include: 

To provide the information, product or service requested by the individual or as reasonably expected given the context in which with the Personal Information was collected (such as customer credentialing and providing customer service, and dispute resolution); 

Verifying the consumer’s identity and other information necessary to provide information regarding the services or information that PRB agreed to provide to the consumer; 

For customer communications, including transactional messages, calls, faxes and to provide customer service and answer customer inquiries.    

Operational Purposes may include:

To protect the security and integrity of our records, systems, networks, and data, including detecting, analyzing and resolving security threats, and collaborating with cybersecurity centers, consortia and law enforcement about imminent threats;

For fraud detection and prevention;

For legal and regulatory compliance, including all uses and disclosures of personal information that are required by law or reasonably needed for compliance with company policies and procedures, such as: anti-money laundering programs, security and incident response programs, intellectual property protection programs, and corporate ethics and compliance hotlines;

For corporate auditing, analysis and reporting;

To enforce our contracts and to protect PRB against injury, theft, legal liability, fraud or abuse, and to protect people or property, including physical security programs; and/or

For corporate governance, including mergers, acquisitions and divestitures.

5. THE CCPA AND CPRA CATEGORIES OF PERSONAL INFORMATION WE MAY SHARE FOR A “BUSINESS PURPOSE”

While we do not sell your Personal Information, we may share it to support our own operational purposes in providing services to you, as described in our Privacy Policy. These operational purposes, known as “business purposes” under the CCPA and CPRA, are described below. In addition, we may share Personal Information at your direction. Please refer to Section 8 of this Supplemental Privacy Policy for additional information regarding our data retention policies.

5.1 Auditing Interactions

We may share the types of Personal Information listed in section 4 with partners, service providers and related companies, in order to audit interactions and transactions, such as to count or verify the positioning and quality of ad impressions.

5.2 Security Purposes

In order to secure our website and/or internal computer network, including to detect, prevent and investigate security incidents or violations of our terms of service or applicable laws, we may share the types of Personal Information listed in Section 4 with our partners, service providers, law enforcement and related companies.

5.3 Service Improvements

In order to improve our goods and/or services, we may share the types of Personal Information listed in section 4 with our partners, service providers and related companies.

5.4 Service Providers and Other Notified Purposes

We may share the types of Personal Information listed in section 4 with “Service Providers” as defined by the CCPA and CPRA, in order to have them perform services specified by a written contract or with others for a notified purpose permitted by the CCPA and CPRA (e.g., to respond to law enforcement requests).

6. WHEN WE COLLECT YOUR PERSONAL DATA 

We collect your personal data when you contact us via our “Contact Us” page, call or fax us. 

7. PROTECTION OF PERSONAL DATA AT PRB 

At PRB, we believe that great privacy rests on great security. PRB follows best practices for storing all company data including Personal Information collected from web inquiries.  Personal data is only accessible by authorized employees using multi-factor authentication. When storing information, we strive to protect its security by encryption and pseudonymization of critical data if necessary. 

We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personally identifiable customer information. 

Although we take all these measures to maintain the safety and security of your Personal Information, please note that no transmission over the Internet can ever be guaranteed to be secure. Consequently, please note that we cannot fully guarantee the security of any Personal Information that you transfer over the Internet to us. We are constantly working to improve on these safeguards to help keep your personal data secure.

8. HOW LONG WE KEEP YOUR PERSONAL DATA 

We may retain your personal data for a period of time consistent with the original purpose of collection or as long as required to fulfill our legal obligations. We determine the appropriate retention period for personal data on the basis of the amount, nature, and sensitivity of the personal data being processed, the potential risk of harm from unauthorized use or disclosure of the personal data, whether we can achieve the purposes of the processing through other means, and on the basis of applicable legal requirements (such as applicable statutes of limitation).

After expiry of the applicable retention periods, your personal data will be deleted. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will implement appropriate measures to prevent any further use of such data.

9. HOW TO EXERCISE YOUR RIGHTS UNDER THE CCPA AND CPRA

Please note that we will need to verify your identity before we can fulfill your privacy-related request. The information that we maintain is subject to CCPA and CPRA generally consists of marketing information, we will generally verify your identity using your email address. We will respond to requests using the email address that is associated with the information we maintain.

If you would like to designate an agent, please send an email from your own email address to info@pacificridgebuilders.com indicating the name and email address of your agent. We will respond to that’s person’s requests using both your email address and the agent’s email address.

Please understand that your rights are subject to some limitations:

If you request that we delete your Personal Information, we will do so except in those situations where our retention is required for our internal business purposes or otherwise permitted by CCPA and CPRA (such as for fraud prevention or legal compliance). In these situations, we will retain your information in accordance with our records retention policies.

We will update this Privacy Statement from time to time to reflect changes in our practices, technologies, legal requirements, and other factors. If we do, we will update the “effective date” at the top. If we make a material update, we may provide you with notice prior to the update taking effect, such as by posting a notice on our website or by contacting you directly, or where required under applicable law and feasible, seek your consent to these changes.

We encourage you to periodically review this Privacy Statement to stay informed about our collection, processing and sharing of your Personal Data.
